Agreement for the Implementation of the Provisions of the United Nations Convention on the Law of the Sea (UNCLOS) of December 10 1982 Relating to the Conservation and Management of Straddling Fish Stocks and Highly Migratory Fish Stocks

Structure and Agreements

The United Nations Convention on the Law of the Sea was opened for signature on 10 December 1982 and entered into force on 16 November 1994. It embraces the belief that all problems of ocean space are interrelated and need to be addressed as a whole. In August 1995 the United Nation held a Conference on Straddling Fish Stocks and Highly Migratory Fish Stocks which led to the Agreement for the Implementation of the Provisions of the United Nations Convention on the Law of the Sea of 10 December 1982 Relating to the Conservation and Management of Straddling Fish Stocks and Highly Migratory Fish Stocks, which was adopted on 4 August 1995. However it is not yet in force 30 ratifications or accessions are required before the agreement enters into force, to date there are 27. 

Obligations and follow-up

The Parties to this agreement are bound to ensure the long-term conservation and sustainable use of straddling fish stocks and highly migratory fish stocks (recalling the relevant provisions of the UNCLOS). They are resolved to:

Improve co-operation between States to that end
Call for more effective enforcement by flag States, port States and coastal States of the conservation and management measures adopted for such stocks
Improve management of the seas with reference to the problem of uncontrolled and excessive fishing in particular
Commit themselves to responsible fisheries
Avoid adverse impact on the marine environment and preserve biodiversity
Recognise the need for specific assistance in order that developing states can participate effectively in the agreement
